First off we would like to wish all our readers a very happy, prosperous and peaceful 2011 and hope all of you had a wonderful time celebrating Christmas and New Year. We apologize for not keeping blogging frequent and active which is mostly due to our commitments, both professional and personal. We may continue not to blog actively even in 2011 on Patent Circle but believe us we do miss blogging considerably.
As far as patent scenario is concerned, there is much vibrancy in India than globally with number of patent oppositions and litigations likely to increase in distant future in India. Many issues such as efficacy under Sec. 3(d), compulsory licensing etc. are still lacking clarity and definitely need diligent and unbiased judicial involvement. Pricing and enforcement of patent right continue to remain a major concern for pharmaceutical companies (concern about pricing may soon become irrelevant if the prices of vegetables continue to sky-rocket making cost of per month vegetables consumption considerably expensive than cost of per month medicine prescription).
Over last couple of years, I realized that there is a considerable gap for information related to Indian patent practice and prosecution proceedings. Possibly I myself actively involved in patent practice realized the need for platform to update and discuss the practices and procedures adopted by the Indian Patent Office (IPO) in handling, examining and rejecting the patent applications. Pre and post-grant opposition decisions may come crucial in formulating diligent approach to prosecute the applications, particularly pharmaceutical applications.
We have been actively updating ourselves with various decisions and orders issued by the IPO and now would be excited to share our review and insights with our readers and fellow patent practitioners and add value to the public domain. We always believed knowledge sharing plays an unparallel role in improvisation of any system and now keeping with our belief, we bring our new initiative ipfeathersblog to discuss practices of the IPO. We hope our readers may welcome and appreciate our new initiative.
