Indian patent law has a unique two-stage provision for opposing patent application, first before grant of patent against the patent application (Pre-Grant Opposition) and second after grant of patent (Post-Grant Opposition). We have listed some of pre-grant and post-grant opposition decisions for quick reference.

Roche v. Wockhardt et al.
IN198952 (Decision)
Wockhardt et al. lost post-grant opposition against the granted patent no. 198952 for biotech Hepatitis C drug pegasys (peginterferon alfa-2a). Interestingly, the Opposition Board recommended revocation of patent but the Assistant Controller of Patents decided against the recommendation of the Opposition Board and upholds the patent.

Roche v. Anand Grover
959/MAS/1995 (Decision)

NGOs approached the Madras High Court against the Assistant Controller decision of granting patent no. 207232 against the patent application no. 959/MAS/1995 for antiviral drug Valganciclovir without giving them opportunity for hearing during pre-grant opposition. On the direction of the Madras High Court, the Chennai Patent Office heard Mr. Anand Grover arguments made in pre-grant opposition and subsequently decided against him. Importantly, the Assistant Controller observed that delay in filing information under Section 8 is purely procedural and not at all ground for opposition under Section 25(1) (h).

Roche v. Ranbaxy
190/MAS/1998 (Decision)
Ranbaxy won pre-grant opposition against the patent application no. 190/MAS/1998 for Roche marketed Xenical (orlistat) capsules for treating obesity. The Assistant Controller of Patents found Roche’s patent application lacking inventive step.
